Lawsuit dismissed

A lawsuit brought by a former nursing student against IVCC and nursing instructor Bonnie Beardsley has been dismissed.

Chief Judge Robert L. Carter of the 13th Judicial Circuit dismissed the suit brought by Alicia Dunn of Peru on Feb. 17.

IVCC attorney Jim Zuehl said, "He (Carter) found the allegations had no legal merit and denied the plaintiff any further opportunity to amend her complaint."

Dunn filed the lawsuit in June 1998 after having failed a nursing course.

The dismissal means Dunn cannot refile in the Circuit Court, but she could file at the appellate level.

Dunn’s original suit was struck by Judge Lewis James Perona in the Circuit Court on Oct. 1, 1998. She then filed an amended complaint.

Beardsley declined to comment on the dismissal.
